what do you think about the use of the drone program? >> i think, listen, once someone is designated as an enemy combatant they're a legitimate target and they can be taken out anytime, on the battlefield, but whether the president can designate an american citizen as an enemy combatant that was raised in the supreme court. where the court seemed to say a president on his own could not designate an american citizen as an enemy combatant for detention. if that's the fact it does raise the question whether or not the president on his own has the authority to designate an american citizen as an enemy combatant for the purposes of a kill. once an american citizen is designated an enemy combatant i think the president as commander-in-chief should have the authority to execute on that with you the first question raises some interesting questions. i don't know today if this matter went to the supreme court, i don't know today if there are five votes to support the authority of the president to do that on his own without any kind of opportunity
